Judicial Department
Mission:
The municipal court shall provide a fair, impartial and timely hearing to all persons charged with violating a municipal ordinance of the Town of Mesilla.
Description:
Jurisdiction: the Municipal Court is a limited jurisdiction court handling criminal actions for petty misdemeanor crimes filed in the name of the municipality as plaintiff against alleged violator. Records: the Court makes and maintains a record of all violations of municipal ordinances filed by police officers or private citizens and further records the disposition of each charge filed in the Court. Disposition of Cases: the Municipal Court Penalty Assessment Program provides for payment of fines for traffic violations without requiring that a defendant appear in court. Court hearings are held, with hours set by municipal ordinance, for the disposition of cases requiring mandatory court appearances or where the defendant requests to appear. For those cases set for hearing, the court, as necessary and in a timely and efficient manner, makes probable cause determinations, sets conditions of release, conducts arraignments, holds trials, enters judgments and, as appropriate, imposes sentence.
